1 On December 15, 1964 George Hinex, hereinafter referred to as the defendant, was charged in the district court of Pottawatomie County with burglary in the second degree, after former conviction of a felony. He was tried before a jury, found guilty as charged, and was sentenced to serve not less than three years, and not more than nine years in the state penitentiary.
